FREE KPI Review: Terms of Service.

Terms of Service

These Terms of Service ("Agreement") govern the use of the free offering provided by Generosity X ("Service Provider") to charitable organizations ("Client") for reviewing their Key Performance Indicator (KPI) data. Please not this free offering is provided by using the "Fundraising Report Card®" tool which has its own terms of service. By accessing or using the Service, the Client agrees to be bound by this Agreement.

Data Usage

1.1 Client agrees to provide the Service Provider with a gift file containing the following information: donor ID, donation amount, and gift date. The Client confirms that no sensitive or personally identifiable information will be included in the gift file.

1.2 The Service Provider will use the provided data solely for the purpose of reviewing and analyzing the Client's fundraising KPIs, in order to identify trends and benchmarks in the fundraising space. The data may be aggregated and anonymized for reporting purposes.

Data Security and Confidentiality

2.1 The Service Provider shall take reasonable measures to protect the confidentiality and security of the Client's data. However, the Client acknowledges that no data transmission over the internet or electronic storage method is completely secure.

2.2 The Service Provider shall not disclose or share the Client's data with any third parties, except as required by law or as otherwise stated in this Agreement.

Ownership and Intellectual Property

3.1 The Client retains all ownership rights to their data provided to the Service Provider.

3.2 The Service Provider retains all rights, title, and interest in the "Fundraising Report Card®" tool, including any intellectual property rights associated with it.

No Fees

4.1 The Service provided under this Agreement is offered free of charge to the Client.

4.2 The Client will never be asked to pay any fees for the Service unless a separate signed agreement is created for additional offerings, which will be governed by its own terms and conditions.

Limitation of Liability

5.1 The Service Provider shall not be liable to the Client for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the Service.

5.2 The Client agrees to use the Service at their own risk and acknowledges that the Service Provider makes no guarantees regarding the accuracy, reliability, or completeness of the analysis or reports generated from the Client's data.

Governing Law and Jurisdiction

6.1 This Agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

Amendments

7.1 The Service Provider may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. The Client should look at the terms regularly and the “Last Updated” date at the beginning of these terms.

If there is a conflict between these terms and any additional terms for a Service, the additional terms will control for that conflict.
